tonight. lisa? >> at this chevron in san jose the praise for regular gas changed twice today. at 3:00 o'clock in the afternoon that sign said 4.23 and at 4:00 o'clock wept up 46 cents. no words are required to feel the driver pain. gas at this station in san bruno is over 5 dollars a gallon. >> 5.19. my god i can't count that high for 89 not even premium. >> last time this bad in california was 2008. and this spike is supposed to be even worse. the reason? gasoline shortage. due to pipeline outage and closure in southern california and the chevron refinery fire in richmond in august. whole sale praise up 1 dollar means the price at the pump is shooting up too. >> 170 dollars for 35 gallon. >>reporter: in southern

7 news reporter lillian explains why this scouts say no and why so many are now fighting on his behalf. >> 17-year-old ryan did everything he was supposed to do to become an eagle scout. he earned the required number of badges and completed the daunting final project just a couple weeks ago. he calls it a tolerance wall which now hangs prom fently at this school. composed of 2 88 tiles each with an anti-bullying message illustrated by school children. >> the school approved this project because we felt it promoted a positive message of

student safety and respecting all differences. >>reporter: but the boy scouts of america is denying ryan eagle scout status because they found out he was game. his mother is now trying to convince the organization to change its anti-gay policy through petition she posted on change.org n.just two days the petition has received tens of thousands of signatures. troop 212 meets here at the red building and everyone who is affiliated with the local boy scouts of america has been issued a gag order which explains why no one has returned our calls. but scout executive did release a statement that said ryan does not meet scouting membership standard on sexual orientation. he became an eagle scout in 19 sfichlt he finds the boy scout policy disappointing. he knows ryan and his family. >> to not get it based on for look of better word a technicality. had nothing to do with his progress and path

to get to this point? yes it's frustrating. >>reporter: ryan and family plan to tell the story on national television next week. this is abc 7 news. archdiocese of san francisco has new leader tonight. hundreds of catholic came to see him installed at saint mary cathedral today. new bishop followed tradition as he entered through the bronze door outside group of followers cheered but gay activist made themselves heard. he's a big opponent of same sex marriages. >> it's the family catholic church believes and marriage between one man and one woman. >> certainly has a right to say the things he says but don't agree with him. nothing wrong with being gay. nothing wrong with our right to marry so we are here to stand against his installation. >>reporter: spokesman for the diocese says archbishop is willing to listen to all his parishioners.

here's a really touching story. 6-year-old san bruno boy who is battling brine cancer collecting halloween costumes for his friends in the hospital. when nick 0heard that he would be able to trick-or-treat because of a break in his treatment he was just delighted. but he felt badly for the kids who were too sick to join him so he and his family start add costume dry. listen to him explain what gave him the idea. >> because the people in the hospital can't go trick-or-treating. >> so did you think wow! they should have costumes too. >> yes. >>reporter: how cute is he. nice kid. to get into the spirit he dressed up as "star wars"storm trooper tonight. treats for people who came to donate too. his family is collecting cost items and go to our web site and click on see it on tv. what a picture that advertise. >> really is. >> in san jose stolen puppy is become home tonight. take a look at the tearful reunion

between 10-year-old marissa and her dog. thieves broke in the home and stole the puppy on monday. yesterday she pleded for the return offering her piggy bank savings as reward. today this woman came forward saying a woman gave her the puppy after finding it wandering in a parking lot in merced county. >> i think thank you to everybody who made this happen. i just can't believe he's in my arms rate now. i i thought it would be going on forever. just so happy here now. >>reporter: he is home. they both look adorable. hug and tears the council member police firefighters presented her with 6000 dlard reward check. she accepted the check but refused marissa piggy bank money. >> kent take the money. that's awesome. >> weather forecast. big weaned coming for activities. >> sandy is here with that for us. >> it's going to be a jam packed weekend of events and don't you worry. we hold off
